1. Introduction and Acceptance of Terms

These Terms of Service ("Terms") are an agreement between you and AIUpscaler.video ("AIUpscaler.video," "we," "us," or "our") covering your use of the AI video upscaling service at aiupscaler.video (the "Service").

By signing up, signing in, or otherwise using the Service, you accept these Terms. If you do not accept them, do not use AIUpscaler.video.

2. Description of Service

AIUpscaler.video is a cloud-based AI service that enhances an existing video. You upload a low-resolution video and receive an enhanced output with higher resolution (up to HD, 2K, or 4K), reduced noise, and optionally a smoother frame rate (up to 60fps). The Service runs in your browser — no software installation is required.

AIUpscaler.video enhances video you already own or have rights to. It does not generate, create, or produce original video from scratch. Output is a downloadable MP4. Quality depends on the input you provide, the settings you select, model behavior, and current system conditions.

3. Eligibility and User Accounts

Eligibility. You must be at least 13 years old to use AIUpscaler.video.
Account creation. Most features require an account; the information you provide must be accurate and your own.
Account security. Keep your credentials confidential. You are responsible for everything that happens under your account. Notify us immediately at support@aiupscaler.video if you suspect unauthorized use.

4. Credit Packs and Existing Subscriptions

4.1 Credit System

The Service uses a credit-based system. The credit cost of a task depends on the engine you choose, the output resolution, the target frame rate, and the duration of your video. The exact credit cost is shown before you confirm each task.
A paid credit balance is required to run tasks. New purchases are one-time credit packs; new subscriptions are no longer offered. Existing subscriptions continue under their existing billing terms. There is no free tier and no sign-up bonus credits.
Existing subscription plans keep their credit allotments, shown in your account.

4.2 Allocation and Expiration

Existing monthly subscriptions: the full monthly allotment is granted at the start of each billing period.
Existing annual subscriptions: credits are granted monthly across the year (one-twelfth per month) rather than all at once, even though billing is annual and upfront.
Subscription credits do not roll over and expire at the end of each monthly cycle. Unused subscription credits are forfeited at expiration.
New credit packs never expire and do not renew automatically. Previously purchased packs retain their original expiration dates. Credit validity does not extend video storage or change the account-deletion rules in these Terms.
Credits with the earliest expiration date are used first; credits without an expiration date are used after credits that expire.
Credits are non-transferable and have no cash value.

4.3 Usage Limits and Fair Use

To keep the Service stable for everyone, we enforce:

Concurrency: up to 2 simultaneous tasks per user.
Daily safety cap: a per-tier daily task ceiling that prevents bursty abuse; under normal use it is well above your monthly allotment and you will not feel it.
Failure refund: if a task fails because of a system error on our side or our AI provider's side, the credits consumed for that task are returned to your balance automatically. This is a credit refund, not a cash refund.

We may revise these limits, the credit formula, or plan benefits with reasonable notice via the pricing page or in-product messaging.

4.4 Video Output

Outputs are MP4 files. Available output resolutions (up to HD, 2K, or 4K) and frame-rate options depend on the engine you select and your plan.
To protect service stability, certain high-cost combinations carry per-task duration limits (for example, 4K output and high-frame-rate output are limited to shorter durations). Any applicable limit is shown before you confirm a task.

4.5 Downloading and Export

You can download MP4 outputs from your task history. Subject to these Terms, you may use the outputs for personal or commercial purposes on any plan.

5. Pricing, Payments, and Taxes

All new credit pack purchases are processed by Stripe, which accepts major credit and debit cards. PayPal is not offered for new purchases. Existing PayPal subscriptions continue to be billed and managed by PayPal until they are canceled, expire, or are migrated; changes to an existing PayPal subscription may also be handled by PayPal.
Prices are displayed in USD.
For existing subscriptions, your authorization for us and our payment processors to charge the recurring fee for your selected plan continues until you cancel.
Any taxes, duties, or similar charges that apply to your purchase are your responsibility.
Prices may change with reasonable advance notice.

6. Cancellation and Refund Policy

6.1 Cancellation

You can cancel anytime from your account settings or by contacting support@aiupscaler.video.
After cancellation, you keep access through the end of the current billing period.
Once cancellation takes effect, monthly credit grants stop and any remaining subscription credits expire. A cancellation does not affect a separately purchased credit pack balance (subject to the validity recorded at purchase).

6.2 Refunds

Subscriptions are generally non-refundable once a billing period has started, and we do not refund unused time or unused credits within a billing period.
Credit packs are generally non-refundable for cash once credits have been granted to your account.
Failed tasks: if a task fails due to a system error, the credits used for that task are automatically restored to your balance. This is a credit restoration, not a cash refund.
Exceptional circumstances: in rare cases — such as a verifiable billing error or double-charge — a refund may be granted at our sole discretion on a case-by-case basis. Granting one refund creates no obligation to grant others.
Applicable law: nothing here limits any mandatory refund right you may have under the consumer protection laws of your jurisdiction; where such a right applies, it prevails.

7. Your Content and Generated Outputs

7.1 Your Responsibilities

You are responsible for:

The video files you upload and the settings you submit
Holding the necessary rights, licenses, or permissions for those inputs (including for any real persons depicted)
The way you use the resulting outputs

You must not use the Service to break any law or to violate someone else's rights, including copyright, trademark, privacy, publicity, or personality rights.

7.2 Ownership / Rights in Outputs

As between you and us, you retain your rights in the videos you upload. Subject to these Terms and applicable law, you may use the upscaled MP4 outputs for personal or commercial purposes on any plan.

Important: none of this gives you rights in third-party material. If your input contains a copyrighted work, a real person without consent, a trademarked work, or anything else you are not authorized to use, the enhanced output is no more lawful than the original — and that is on you.

7.3 License to Operate the Service

You grant us a limited, worldwide, non-exclusive, royalty-free license to host, transmit, store, process, and display your inputs and outputs only as needed to operate, secure, and maintain the Service, which covers:

Running the AI upscaling pipeline and returning your output
Retaining files within the retention windows described in the Privacy Policy
Powering your task history
Enforcing usage limits, billing rules, and abuse prevention
Providing technical support and resolving issues

7.4 No Training on Your Content

We do not use your uploaded video files to train AI models.

8. NSFW and Explicit Content Policy

You may not upload, process, or distribute NSFW or sexually explicit material through AIUpscaler.video. This covers nudity, pornographic content, sexual acts, sexualization of real persons or minors, and any related adult content — regardless of fictional framing. Violating accounts will be terminated immediately, and where the law requires, reported to authorities. Account termination for policy violations does not create any right to a cash refund of amounts already paid.

This policy applies to all uploaded video files, all output (upscaled) videos, and screenshots attached through the private Feedback feature across AIUpscaler.video.

Uploaded videos may be assessed by automated content-safety systems during processing. Private Feedback screenshots are not currently screened automatically before upload; authorized staff may remove prohibited screenshots and take action on the account. Content flagged by a processing provider may be rejected. If a task is blocked for content-safety reasons, processing stops and the credits deducted for that task are restored to your balance. Restoring credits for a single blocked task is separate from the cash-refund position above. Repeated violations will lead to permanent account termination.

9. Prohibited Activities

You agree not to use the Service to upload, process, or distribute content that:

Breaks any applicable law or facilitates illegal activity
Contains hate speech, discrimination, or incitement to violence against an individual or group
Is fraudulent, deceptive, or designed to mislead (including phishing, spam, malware)
Infringes copyrights, trademarks, rights of publicity, privacy, or other intellectual or proprietary rights
Depicts real, identifiable people without their consent — including political figures, public figures, and private individuals — especially for harmful, deceptive, or non-consensual purposes (e.g. deepfakes)
Harasses, bullies, doxxes, or threatens any person
Sexualizes minors or contains content that exploits or endangers minors
Spreads disinformation intended to cause harm

You also agree not to:

Bypass usage limits, rate limits, or other technical safeguards
Use scripts, bots, or automation to abuse the Service
Disrupt service operations, security, or other users' access
Reverse-engineer, decompile, or attempt to extract the source code of the Service or its underlying models

Enforcement. We may suspend or terminate accounts that violate these Terms, with or without prior notice, and without refund where the law allows.

10. AI Output Disclaimer

Upscaled or enhanced videos may contain artifacts, may not perfectly restore lost detail, or may otherwise be unsuitable for your intended purpose.
Outputs depend on your input (source resolution, compression, noise), the resolution and frame rate you select, model behavior, and current system conditions.
We do not guarantee any particular quality, accuracy, detail recovery, or fitness for any purpose.
You are responsible for reviewing outputs before using them anywhere.

11. Privacy

How we handle your data is described in our Privacy Policy. Using the Service indicates your acceptance of those practices.

12. Service Availability and Changes

We make reasonable efforts to keep the Service running but do not guarantee uninterrupted availability or any specific uptime level.
Features, limits, pricing, or the entire Service may be modified, paused, or discontinued at any time, including for maintenance, security, or business reasons.
Where significant changes are planned, we will give reasonable advance notice through the website or in-product messaging.

13. Termination

You may stop using the Service at any time.
We may suspend or terminate your access if you violate these Terms or if we reasonably believe your continued use poses a risk to the Service, our providers, or other users.
Upon termination your right to use the Service ends; we may continue to retain certain records as required by law or for legitimate business reasons.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY ABOUT OUTPUT QUALITY, ACCURACY, OR ANY SPECIFIC RESULT.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AIUpscaler.video WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

WHERE A JURISDICTION DOES NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, THOSE EXCLUSIONS OR LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED THERE.

16. Indemnification

You agree to defend, indemnify, and hold harmless AIUpscaler.video and its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, and costs (including reasonable attorneys' fees) that arise from:

Your use of the Service
Your breach of these Terms
Your breach of any law or third-party right
Inputs you submit or outputs you produce through the Service
